The Passing of Proposition 139 Does the Following:

  • Prohibits any law, regulation, or policy that would deny, restrict, or interfere with the fundamental right to abortion before fetal viability (generally around 24 weeks) unless it is for the limited purpose of improving or maintaining the health of an individual seeking an abortion consistent with clinical practice standards and evidence-based medicine
  • Prohibit any law, regulation, or policy that would deny, restrict, or interfere with an abortion after fetal viability (generally around 24 weeks) that, in the good-faith judgment of the patient’s health care provider, is necessary to protect the patient’s life or physical or mental health
  • Prohibit any law, regulation, or policy that would penalize any person or entity for aiding or assisting a person with exercising their right to an abortion
